Mr. Breeden was extremely helpful to me as I continued on the long road to gain full custody of my daughter. Even though I have never met him in person, he treated my family and I with great respect and attention. I live out of state, yet had to gain counsel of someone in the state of my ex-husband’s residence. Due to the Covid concerns, it was very difficult to even think of traveling back and forth for consultation or scheduled court dates. Mr. Breeden enabled me to conduct all of our business and legal appointments from my own home. No concern was ever too large or small. Mr. Breeden always kept me up to date, and was very good at responding to my calls and emails. I am so thankful to have found his services. He was able to get past a great many previous misconceptions about elements of the case that had been keeping my daughter from me. I would recommend Mr. Breeden to anyone who is looking for serious, helpful and personal counsel.

I cannot possibly begin to say how pleased I was with Mr. Breeden! Mr. Breeden was outstanding in every aspect of my case. First off Mr. Breeden took my case even with me living out of state. Mr. Breeden was all over my ex wife’s lawyers shenanigans at every turn. Mr. Breeders experience was critical in so many ways to put into this post but a few examples Mr. Breeden knew ways of “finding” records to prove or discredit statements made by the other teams witnesses, knowing how witnesses were going to play out even before they were on the stand, Mr. Breeden was all over everything! Being the dad from out of state going to NC with a female Judge and coming out with full primary physical custody….says it all. Thank you sir job very well done.

Understanding Domestic Violence in North Carolina

Domestic violence includes a wide range of abusive behaviors between people in certain personal relationships. Under North Carolina law (§ 50B), this may include spouses, former partners, parents, children, co-parents, housemates, and others with a close personal connection.

Common forms of abuse include:

  • Physical harm or threats of harm
  • Sexual violence or coercion
  • Intimidation, stalking, or harassment
  • Verbal, emotional, or psychological abuse
  • Financial control or isolation from others

You may not always recognize these behaviors as abuse at first—but if someone is using fear, control, or harm to dominate you, legal protection is available. Our team is here to help you understand your rights and take immediate action.

Protective Orders: Your First Step Toward Safety

Protective orders are court-issued mandates designed to keep your abuser away from you and your children. We can help you seek:

Temporary Protective Orders (Ex Parte Orders)

These emergency orders can be granted without the abuser being present in court. They last up to 10 days and are meant to provide immediate safety.

50B Domestic Violence Protective Orders (DVPOs)

This longer-term order requires a court hearing and can offer broader protections, such as no-contact provisions, temporary custody, and removal of the abuser from a shared home.

Attorney Breeden will guide you through the filing process and represent you at every court appearance, helping you stay focused on your safety and next steps.

How to File for a DVPO in Wake County

When you’re ready to file for protection, make sure you work with your attorney to discuss what materials you need to bring and where to file.

When you arrive with your domestic violence lawyer, here’s what you can expect at the Wake County Courthouse:

  1. Go to Room 527 at 316 Fayetteville St. to complete your Domestic Violence Protection Order paperwork.
  2. Bring the forms to Courtroom 5A between 2:00 p.m. and 4:00 p.m.
  3. The judge will ask you to testify under oath.
  4. After approval, return to Room 527 for your official documents.
  5. Visit the Victims Services Unit in Room 542 to finalize the process.

This process can feel overwhelming, especially during a crisis—but with the Breeden Law Office by your side, you won’t have to face it alone.

What Happens if Someone Violates a Protective Order?

If your abuser violates a protective order, that’s a serious offense under North Carolina law. Violating a 50B order can result in Class A1 misdemeanor charges, which may lead to jail time, fines, or additional charges like assault or trespassing.

Jonathan Breeden will work quickly to hold the abuser accountable and enforce your legal protections through the courts.

FAQs about North Carolina Domestic Violence Cases

What should I bring to court when filing for a protective order?

When filing for a DVPO, it helps to bring documentation that supports your case—such as text messages, emails, photos of injuries, police reports, or medical records. A lawyer can also help you prepare your testimony before your hearing.

Can I still get a protective order if I haven’t reported the abuse to police?

Yes. You do not need to have a police report to request a protective order in North Carolina. The judge will listen to your sworn testimony and evaluate the evidence you provide. Your safety is what matters most.

Will my abuser find out where I am staying?

No. North Carolina has address confidentiality programs that protect your location and contact information. Your attorney can help you register for these services so you can seek safety without fear of being tracked down.

Can I include my children in a protective order?

Yes. If your children are also at risk or have been harmed, you can ask the court to include them in your protective order. This can limit the abuser’s contact with your children and help establish temporary custody arrangements.

What if I’m afraid to go to court alone?

It’s okay to feel scared when you’ve been hurt in a domestic violence situation. You don’t have to attend hearings on your own. Many community organizations provide trained courtroom companions or advocates who will accompany you. Your attorney can also be present to represent you and speak on your behalf whenever possible.
