  1. You Need Objective Advice

Even when everyone involved is cordial and shares the same goals, handling domestic issues legally can get deeply emotional and tense. Personal feelings can affect your ability to make the best decisions. Unemotional guidance from a lawyer provides you clear direction, and the logic and practical knowledge of the law keeps the focus on long-term goals, not cheap wins.

  2. Everything Has to be Accurate

You may think that using a “do it yourself” divorce, child support, or custody service will be cheap and easy. However, that method could end up much more expensive for you in the long run. A simple mistake in the paperwork, missing information, or a missed deadline could cost you a lot of time and money, or put you at a disadvantage. A family lawyer can ensure everything is complete, correct, and timely.

  3. Lawyers Know the Law

Even amicable divorces and family legal matters have complexities you’re likely overlooking. It seems obvious, but lawyers know the law and undergo extensive training to recognize and address potential complications.

  4. You & Your Family Need Protection

If your spouse has a lawyer and you don’t, you may find yourself on less than stable footing in a divorce. Your divorce decree could put you in a less-than-ideal position – uneven property division, unfair custody plans, or harsh alimony payments. A lawyer protects you and your best interests as you fight to safeguard your family’s future and well-being.

  5. You May Need to Go to Court

Not every legal issue goes through a trial, but some family matters require litigation to reach a resolution. Our goal is to avoid going through a lengthy court trial. Sometimes negotiations break down, mediations fall apart, and you need to fight in court for your family. An experienced lawyer with proven success in family court can give you a huge advantage, even if you agree that a court battle is not necessary. We prepare each case for trial, and fight to get your resolution outside of the courtroom.

Child Custody

Raleigh Child Custody Lawyer

Whether you are in the process of ending your marriage, divorced or never married, you need to know your rights and how to assert them. While there are several factors that influence child custody decisions, what’s best for the child is the core of the question.

At Breeden Law Office, we have extensive experience handling cases dealing with child custody, visitation, support, and other issues involving children. Let our child custody lawyers help you reach an outcome that is positive for you and your children.

Types of Child Custody in NC

  • PRIMARY CUSTODY – The child lives full-time with the parent granted primary custody.
  • SECONDARY CUSTODY – This parent has scheduled visitation rights with the child.
  • JOINT CUSTODY – The child divides their time equally between both parents.

Child Support

Raleigh Child Support Lawyer

Child support is meant to help with the expense of raising a child. It is not designed to punish parents. Whether you’re asking for support or being asked to pay, you need to understand your rights.

A number of factors influence child support decisions in Raleigh. Fortunately, Jonathan Breeden is an experienced and tenacious advocate for parents looking for help with their child support concerns. Jonathan will clearly explain your options and obligations.

As a skilled negotiator, he will represent your best interests when coming to an agreement, and he’s a tough trial lawyer that you’ll want fighting for you if your child support case goes to court.

Your Initial Consultation

At your first meeting with our Raleigh-area team, you will discuss your situation. We will review your circumstances, what you hope to accomplish by the end of our process, and what success means in your case. From there, we’ll create a unique plan for you.

Consultations are easy, convenient, and may be the first step in your family’s new, better life.

Jonathan Breeden has more than 25 years of experience and is a fixture in the area’s local family courts, handling domestic cases in Cary, Raleigh, Harnett County, and Johnston County.

Start Collecting Documents & Information

This meeting can happen after you’ve decided on your course of action — we’ve outlined your goals, now we need to set us up for success. Before we can file any documents with the court, we need supporting documents that will help your claim in court.

The documents you need depend upon your unique situation. Some cases may require similar documents, but one of our family law attorneys can ensure they explain which ones you need.

Once you have your documents, you can file a motion to start your family law case.

03 / 04

File Your Motion in Family Law Court

Once you have gathered the necessary documents, our attorneys will help you fill out the correct forms and file them with the proper family court. The rest of your case depends on the outcome you’re seeking, but never fear — we will be with you every step of the way.

You might need to wait for an answer from your soon-to-be-ex in a divorce case, or from the court to discuss scheduling your hearing to modify child custody. No matter what, our team will be answering your questions and monitoring developments as your case continues.

04 / 04

Settlement Negotiations, Hearings & Trials

Once your case is underway, both parties and their attorneys can start negotiations. Negotiating a resolution is one way to keep the fight out of court or to limit the time you need to spend in a court room. You can resolve most issues connected to your family law matter outside of court, but if no agreement is reached, hearings and trials may be the only way to move forward.

Your lawyer will be able to explain the benefits of either negotiating before going to court or taking your case to trial, but the decision will be up to you. You may just need a hearing to present the terms of your agreement to a judge for their approval, or you may need a trial for the judge to see all facets of the issue at hand before a decision is reached.

The family law attorneys at the Breeden Law Office have extensive trial experience, and we’re ready to reach the resolution that gets you the best possible outcome.
